Terms of Service & Booking Policies

Welcome to Porch Pumpkins™.

These Terms of Service ("Terms") govern your use of the Porch Pumpkins™ website and your purchase of our seasonal entrance styling, design, installation, pumpkin removal, and related services.

For the purposes of these Terms, "Porch Pumpkins™," "we," "us," and "our" refer to Polarex Enterprises Canada Inc., carrying on business as Porch Pumpkins™.

By accessing our website, requesting a quote, booking a service, or purchasing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Porch Pumpkins™ provides professionally designed seasonal entrance styling, including curated pumpkin installations, optional decorative enhancements, and optional end-of-season pumpkin removal.

Each installation is individually designed on-site by our design team to complement your home's architecture, entrance, and surrounding landscape.

Bookings are completed through our online booking system.

Full payment is required at the time of booking. A booking is not confirmed until full payment has been received and a booking confirmation has been issued by Porch Pumpkins™. Upon confirmation, Porch Pumpkins™ may begin allocating seasonal inventory, installation capacity and other resources to the booking.

Once your payment has been successfully processed, your booking is confirmed, and you will receive a booking confirmation by email.

If payment cannot be processed, is declined, or is reversed for any reason, Porch Pumpkins™ reserves the right to cancel or refuse the booking until payment has been received in full.

All prices are quoted in Canadian dollars unless otherwise stated.

Applicable taxes will be added where required by law.

Prices displayed on our website are subject to change without notice. However, once a booking has been confirmed, your collection price will be honoured.

Optional enhancements, including lanterns, mums, and pumpkin removal, are priced separately unless otherwise stated.

All prices are quoted in Canadian dollars (CAD) unless otherwise stated and are subject to applicable taxes.

Porch Pumpkins™ reserves the right to correct pricing errors or inaccuracies and to update pricing at any time prior to a booking being completed.

Any chargebacks, unauthorized payment disputes, or fraudulent payment activity may result in the cancellation of services and any other remedies available under applicable law.

Installations are completed during the seasonal installation period announced each year.

Customers may select a preferred installation week during the booking process; however, exact installation dates and times cannot be guaranteed.

Installation schedules may be adjusted due to:

• Weather conditions;
• Supplier deliveries;
• Transportation delays;
• Traffic;
• Staffing requirements;
• Safety considerations; or
• Other operational requirements beyond our reasonable control.

Porch Pumpkins™ will make every reasonable effort to notify customers of any scheduling changes.

Customers agree to:

• Provide safe and unobstructed access to the installation area;
• Ensure walkways, stairs, and entrances are reasonably clear and safe;
• Remove personal belongings from the installation area before our arrival;
• Provide any required gate codes or access instructions; and
• Notify Porch Pumpkins™ of any irrigation systems, lighting, electrical wiring, or other property features that could affect installation.

Failure to provide safe access may result in the installation being postponed.

By booking our services, you authorize Porch Pumpkins™ to enter your property for the purpose of performing the agreed-upon services.

If no one is present at the property during the scheduled installation, Porch Pumpkins™ may complete the installation provided safe access has been arranged in advance.

Every Porch Pumpkins™ installation is professionally designed by our team.

Our collections are intended to reflect the overall style, quality, and aesthetic shown throughout our website and promotional materials. Individual installations are not intended to replicate a specific photograph.

Final placement, layering, styling, pumpkin selection, and all artistic decisions remain solely at the discretion of Porch Pumpkins™.

No two installations will be identical. Natural variations in pumpkins and on-site conditions make each display unique.

Pumpkins are natural agricultural products, and variations in colour, size, shape, texture, stems, markings, and natural imperfections are to be expected. These characteristics are part of the unique beauty of each installation and are not considered defects.

Natural products vary from season to season, and no two pumpkin harvests are identical.

Pumpkin varieties, colours, and sizes are subject to seasonal availability.

If specific varieties become unavailable due to crop conditions, supplier shortages, weather, or other circumstances beyond our control, Porch Pumpkins™ reserves the right to substitute pumpkins of comparable quality, size, colour, or visual style while maintaining the overall design aesthetic of the selected collection.

Such substitutions do not constitute a material change to the service purchased.

The lifespan of pumpkins varies depending on weather conditions, temperature fluctuations, rainfall, sunlight, humidity, wildlife activity, insects, and other natural environmental factors.

Because these conditions are beyond our control, Porch Pumpkins™ cannot guarantee the lifespan, appearance, or condition of pumpkins after installation.

Customers are encouraged to care for their pumpkins in accordance with any care recommendations provided by Porch Pumpkins™ to help maximize their longevity.

The safety of our team and the quality of every installation are our priorities.

Installation dates may be postponed due to severe weather, unsafe working conditions, or other circumstances that make installation impractical or unsafe.

If this occurs, Porch Pumpkins™ will make every effort to reschedule the installation at the earliest practical opportunity.

Weather-related scheduling adjustments do not constitute a cancellation and are not grounds for a refund.

As natural products, pumpkins may attract wildlife, insects, or pets.

Porch Pumpkins™ is not responsible for damage or deterioration caused by squirrels, raccoons, deer, birds, insects, pets, frost, excessive heat, heavy rainfall, wind, mould, or other natural environmental conditions.

Once an installation has been completed, requests for redesigns, relocation of pumpkins, additional styling, replacement pumpkins, or other changes may be accommodated at the discretion of Porch Pumpkins™ and may be subject to additional service fees.

Pumpkin removal is available as an optional add-on service during the booking process.

If purchased, Porch Pumpkins™ will remove pumpkins during our scheduled seasonal removal period.

Customers who do not purchase the removal service are responsible for disposing of all pumpkins and decorative materials at the end of the season.

We understand that circumstances can change after a booking has been confirmed. Our cancellation and change policy is designed to provide flexibility to our customers while recognizing the advance commitments required to plan and prepare each Porch Pumpkins™ installation.

If you are unable to proceed with your installation, the amount paid, less a $250 cancellation fee, will be applied as a credit toward a Porch Pumpkins™ installation during the following fall season. Payments are not refundable to the original method of payment.

The $250 cancellation fee is non-refundable and is retained to help offset costs and commitments associated with advance purchasing, seasonal inventory, storage, handling, planning, administration, staffing and reserved installation capacity. Because pumpkins are a highly seasonal and perishable product, these costs and commitments may be incurred well in advance of your scheduled installation.

Seasonal credits are valid for the following fall season only and are applied based on their dollar value. Credits have no cash value, cannot be redeemed or exchanged for cash, and cannot be carried forward beyond the following fall season. Collections, pricing and availability may change from season to season. If the cost of your selected collection or additional services in the following season exceeds the value of your available credit, you will be responsible for the difference.

As an alternative to receiving a seasonal credit, you may request to transfer your current-season booking to another person at an installation address within one of our designated service areas. Transfer requests should be made as early as possible and are subject to availability, routing, scheduling and our ability to service the new installation address.

Changes to Your Booking

We will make every effort to accommodate changes to your booking. Requests to change your collection, installation week, installation address, enhancements or other booking details should be made as early as possible and are subject to inventory, scheduling, routing, service-area and installation capacity.

If you upgrade your collection or add additional products or services, any additional amount owing must be paid when the change is confirmed.

If you change to a lower-priced collection or remove previously purchased enhancements or services, any resulting difference will be issued as a Porch Pumpkins™ credit rather than refunded to the original method of payment.

Changes requested close to your scheduled installation may not always be possible where inventory, staffing, routing or other resources have already been committed. Porch Pumpkins™ will make every effort to accommodate such requests whenever operationally possible.

Porch Pumpkins™ may photograph completed installations for use on our website, social media platforms, advertising, promotional materials, and other marketing purposes.

Unless you specifically request otherwise in writing before your installation, you grant Porch Pumpkins™ permission to photograph your completed display for these purposes.

We will never publish your name, street address, or other personal information without your consent.

All content displayed on the Porch Pumpkins™ website, including but not limited to photographs, graphics, logos, designs, branding, text, artwork, collection names, videos, layouts, and other materials, is the property of Porch Pumpkins™ or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

The Porch Pumpkins™ name, logo, branding, and all original website content may not be copied, reproduced, modified, distributed, republished, displayed, or used for commercial purposes without the prior written consent of Porch Pumpkins™.

Nothing contained within these Terms grants any licence or right to use any intellectual property belonging to Porch Pumpkins™ without our prior written permission.

The photographs, renderings, and images displayed throughout our website represent examples of our work and are intended to illustrate the overall style and quality of our collections.

Because every installation is individually designed using natural products, each display will vary based on the property, seasonal availability, pumpkin characteristics, and our professional design decisions.

Porch Pumpkins™ does not guarantee that any installation will exactly match photographs or promotional images shown on our website or social media.

To the fullest extent permitted by applicable law, Porch Pumpkins™, Polarex Enterprises Canada Inc., its owners, employees, contractors, representatives, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of our website or services.

Without limiting the foregoing, Porch Pumpkins™ shall not be responsible for losses or damages resulting from:

• Weather or environmental conditions;
• Wildlife, insects, or pets;
• Natural deterioration of pumpkins or other seasonal materials;
• Delays caused by circumstances beyond our reasonable control;
• Pre-existing conditions of the customer's property; or
• Customer actions or omissions.

Our total liability for any claim relating to our services shall not exceed the amount paid by the customer for the specific services giving rise to the claim.

You agree to indemnify, defend, and hold harmless Porch Pumpkins™, Polarex Enterprises Canada Inc., its owners, officers, employees, contractors, and representatives from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of:

• Your breach of these Terms;
• Your misuse of our website or services;
• Your negligence or intentional misconduct; or
• Any claim resulting from information or instructions provided by you.

Porch Pumpkins™ respects your privacy.

Personal information collected through our website or booking process is used solely to process bookings, communicate with customers, provide our services, process payments, improve our website, and comply with legal obligations.

Please refer to our Privacy Policy for complete details regarding how your personal information is collected, used, stored, and protected.

Porch Pumpkins™ shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond our reasonable control, including but not limited to:

• Severe weather;
• Natural disasters;
• Fire;
• Flood;
• Crop failures;
• Supplier shortages;
• Transportation disruptions;
• Labour disputes;
• Government restrictions;
• Public health emergencies; or
• Any other event beyond our reasonable control.

In such circumstances, Porch Pumpkins™ may postpone, reschedule, modify, or cancel services as reasonably necessary.

These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada.

Any dispute arising from these Terms or the services provided by Porch Pumpkins™ shall be subject to the exclusive jurisdiction of the courts of Ontario.

Porch Pumpkins™ reserves the right to modify or update these Terms at any time without prior notice.

The most current version will always be posted on our website together with its effective date.

Continued use of our website or services following any changes constitutes acceptance of the revised Terms.
